By registering for, accessing or using Nyaabs Pay, you confirm that you have read, understood and agreed to these Terms, together with our Privacy Policy and any other terms or notices applicable to particular services.

Please read these Terms carefully before using Nyaabs Pay.

1. ABOUT NYAABS PAY

Depending on the service available to you, Nyaabs Pay may facilitate:

1.Wallet services;

2.Wallet top-ups;

3.Wallet withdrawals;

4.Mobile Money transactions;

5.Transfers between users;

6.Bank transfers;

7.Airtime purchases;

8.Data bundle purchases;

Some services may be provided, processed or settled by third-party banks, electronic money issuers, telecommunications companies, billers, payment service providers or other authorised partners.

The availability of a particular service may therefore depend on the relevant third-party provider.

To use Nyaabs Pay, you must:

  1. Be at least 18 years old;
  2. Have the legal capacity to enter into a binding agreement;
  3. Provide accurate and complete information during registration;
  4. Provide information and documents required for identity verification and Know Your Customer (KYC) procedures; and
  5. Comply with applicable laws and these Terms.

Nyaabs Pay reserves the right to refuse, restrict or suspend access where required by law, regulatory requirements, security considerations or our internal risk controls.

3. ACCOUNT REGISTRATION

You must provide accurate, current and complete information when creating your Nyaabs Pay account.

Depending on the service and applicable regulatory requirements, we may request information including:

1.Full legal name;

2.Ghana Card or other approved identification;

3.Telephone number;

4.Date of birth;

5.Residential or business address;

6.Email address;

7.Source of funds or other information where legally required; and

8.Additional information or

documentation required for KYC

AML/CFT or fraud-prevention purposes.

You are responsible for ensuring that all information provided to us remains accurate and up to date.

Providing false, misleading or fraudulent information may result in restriction or closure of your account and may be reported to the appropriate authorities where required.

4. CUSTOMER IDENTIFICATION AND KYC

Nyaabs Pay may conduct identity verification, customer due diligence, enhanced due diligence and ongoing monitoring as required by applicable Ghanaian laws, regulatory requirements and the requirements of our authorised or licensed partners.

We may request additional information where necessary to:

  • Verify your identity;
  • Prevent fraud;
  • Prevent money laundering and terrorist financing;
  • Comply with sanctions and regulatory requirements;
  • Protect our customers and the payment system; or
  • Meet requirements imposed by our financial or payment partners.

If you do not provide information reasonably required for these purposes, certain services may not be available to you.

5. YOUR NYAABS PAY WALLET

Where wallet functionality is available, your Nyaabs Pay wallet may allow you to hold an electronic balance for permitted transactions.

Wallet funds and related settlement arrangements may be maintained, safeguarded or processed through an authorised/licensed financial or payment service partner in accordance with the applicable regulatory and contractual arrangements.

Your Nyaabs Pay wallet is not a bank account unless expressly stated otherwise.

Nyaabs Pay does not pay interest on wallet balances unless a specific product expressly provides otherwise and is permitted under applicable law.

You may not use your wallet for unlawful activities or transactions prohibited by law or by our policies.

6. TOP-UPS

You may fund your Nyaabs Pay wallet using the available payment methods displayed on the platform.

A top-up is considered successful when the transaction has been successfully confirmed by the relevant payment provider and the funds have been credited to your Nyaabs Pay account.

A top-up may be delayed, rejected, reversed or subject to additional verification because of:

  • Payment-provider processing
  • Network interruptions
  • Incorrect customer information
  • Fraud or security controls
  • Regulatory requirements
  • Insufficient funds; or
  • Other circumstances outside Nyaabs Pay's reasonable control.

Where a top-up fails but funds have been deducted from your external account, we will work with the relevant payment provider to investigate and process an eligible reversal or refund.

7. WITHDRAWALS

Where wallet withdrawals are available, you may request withdrawal of eligible funds using the withdrawal methods made available by Nyaabs Pay.

Withdrawals may be subject to:

  • Transaction limits
  • KYC requirements
  • Security verification
  • Fraud and risk checks
  • Applicable fees
  • Processing times; and
  • Requirements of the relevant payment or financial institution.

A withdrawal request may be delayed or rejected where additional verification is required or where the transaction cannot legally or technically be processed.

8. TRANSFERS AND PAYMENTS

Nyaabs Pay may allow you to send funds to supported Mobile Money accounts, bank accounts, Nyaabs Pay users or other supported recipients.

Before confirming a transaction, you should carefully review:

  • Recipient information
  • Amount
  • Applicable fees
  • Transaction type and
  • Any other information displayed on the confirmation screen.

You are responsible for ensuring that recipient details are correct before authorising a transaction.

Where a transaction has been successfully completed to the intended recipient, recovery may not always be possible.

Nyaabs Pay will make reasonable efforts to assist with eligible disputes or erroneous transactions, but recovery may depend on the receiving institution, telecommunications company, payment provider or other relevant party.

9. AIRTIME AND DATA

Nyaabs Pay may allow customers to purchase airtime and data bundles from supported telecommunications providers.

You are responsible for entering the correct telephone number, network and package information before confirming the transaction.

Once airtime or a data bundle has been successfully delivered, it may not be refundable except where required by applicable law or where the relevant service provider authorises a reversal.

10. BILL PAYMENTS

Nyaabs Pay may facilitate payment of supported bills and services, including:

  • Electricity
  • Water
  • DStv
  • GOtv and
  • Other supported billers.

You are responsible for entering accurate account, meter, subscriber or customer information.

A bill payment may be processed through a third-party biller or payment provider.

Where a payment has been deducted but the biller has not immediately confirmed the payment, Nyaabs Pay may place the transaction in a pending status while confirmation is obtained.

Where appropriate, we may investigate and process an eligible reversal or refund after confirmation from the relevant provider.

11. USSD SERVICES

Where Nyaabs Pay USSD services are available, customers may access supported services through the designated USSD channel.

USSD transactions may require authentication through a PIN, OTP or other security mechanism.

You are responsible for protecting your PIN, OTP and mobile device.

USSD services may be affected by telecommunications network availability or third-party service interruptions.

12. TRANSACTION AUTHORISATION

You are responsible for all transactions authorised using your account credentials, PIN, OTP or other authentication methods, except where applicable law provides otherwise.

You must never disclose your:

  • Password
  • PIN
  • OTP
  • Security codes or
  • Other authentication credentials

to another person, including someone claiming to be a Nyaabs Pay employee.

Nyaabs Pay will not ordinarily ask you to disclose your complete PIN or OTP.

If you believe that your account or security credentials have been compromised, you must contact Nyaabs Pay immediately through the available support channels.

13. FEES AND CHARGES

Nyaabs Pay currently charges a 1% transaction/service fee, unless a different fee is clearly displayed and communicated to you before a transaction is confirmed.

Applicable fees will be displayed to you before completion of the relevant transaction where technically and operationally applicable.

Third-party providers may impose additional charges where applicable. Where such charges are known and applicable, Nyaabs Pay will seek to disclose them before transaction confirmation.

Nyaabs Pay may change its fees in accordance with applicable laws, regulatory requirements and these Terms. Where required, customers will be given appropriate notice of material changes.

14. TRANSACTION LIMITS

Transactions may be subject to daily, monthly or per-transaction limits.

Limits may be determined by:

  • Applicable Ghanaian laws and regulations
  • Bank of Ghana requirements
  • KYC level
  • Account type
  • Service type
  • Risk controls
  • Third-party provider limits; or
  • Nyaabs Pay internal policies.

Nyaabs Pay may change transaction limits where necessary to comply with regulatory, security or operational requirements.

15. FAILED, PENDING AND REVERSED TRANSACTIONS

A transaction may appear as pending where confirmation has not yet been received from the relevant payment provider, bank, Mobile Money operator or biller.

Customers should not repeatedly initiate the same transaction while an earlier transaction remains pending unless instructed to do so by Nyaabs Pay.

Where a transaction fails after funds have been deducted, Nyaabs Pay will investigate the transaction with the relevant provider.

Where the transaction is confirmed as unsuccessful and the customer is entitled to a reversal, the funds will be returned in accordance with the applicable processing and settlement procedures.

Some reversals may take time because they depend on external financial institutions, telecommunications operators, billers or payment processors.

16. REFUNDS

Refunds will be handled according to the nature of the transaction and the applicable rules of the relevant service provider.

A refund may not be available for a successfully completed service, including certain airtime, data or bill payments, where the relevant provider has already delivered the service.

Where a refund is approved, it may be credited to the customer's Nyaabs Pay wallet, original funding source or another permitted destination.

17. FRAUD AND PROHIBITED ACTIVITIES

You must not use Nyaabs Pay for:

  • Fraud
  • Money laundering
  • Terrorist financing
  • Sanctions evasion
  • Theft
  • Unauthorised transactions
  • Illegal gambling or other prohibited activities
  • Financing unlawful activities
  • Transactions involving proceeds of crime
  • Impersonation or identity fraud;
  • Attempting to circumvent transaction or KYC limits or
  • Any other activity prohibited by Ghanaian law.

Nyaabs Pay may monitor transactions and account activity for security, fraud prevention, AML/CFT and regulatory purposes.

Where required by law, Nyaabs Pay may report suspicious or prohibited activity to the appropriate authorities.

18. ACCOUNT RESTRICTION OR SUSPENSION

Nyaabs Pay may temporarily restrict, suspend or limit an account where reasonably necessary to:

  • Protect the customer or Nyaabs Pay
  • Investigate suspected fraud
  • Investigate suspicious transactions
  • Comply with a legal or regulatory requirement
  • Complete KYC or enhanced due diligence
  • Respond to a court or regulatory order
  • Protect the payment system or
  • Address a breach of these Terms.

Where permitted by law, we will provide appropriate information regarding the restriction and the steps required to resolve the matter.

Certain information may not be disclosed where doing so would breach legal, regulatory, security or law-enforcement requirements.

19. ACCOUNT CLOSURE

You may request closure of your Nyaabs Pay account through the available customer-support channels, subject to completion of any outstanding transactions, disputes, investigations or legal obligations.

Nyaabs Pay may close or restrict an account where permitted or required by law or under these Terms.

Any eligible remaining balance will be handled in accordance with applicable law, regulatory requirements and the relevant account/settlement arrangements.

20. SERVICE AVAILABILITY

Nyaabs Pay aims to provide reliable and accessible services.

However, services may occasionally be unavailable or interrupted because of:

  • Telecommunications failures
  • Internet outages
  • Bank or Mobile Money network interruptions
  • Third-party provider outages
  • Scheduled maintenance
  • Cybersecurity incidents
  • Technical failures
  • Power or infrastructure failures;
  • Regulatory requirements or
  • Other circumstances beyond our reasonable control.

Where required by applicable regulation, Nyaabs Pay will provide appropriate notification regarding significant service disruptions.

21. THIRD-PARTY SERVICE PROVIDERS

Certain Nyaabs Pay services may depend on third parties, including banks, Mobile Money operators, electronic money issuers, billers, payment service providers and telecommunications companies.

The availability, processing time and functionality of a third-party service may be outside Nyaabs Pay's direct control.

Where a transaction depends on a third-party provider, Nyaabs Pay will work with the relevant provider to investigate eligible transaction issues.

22. CUSTOMER RESPONSIBILITIES

You agree to:

  1. Provide accurate information;
  2. Keep your account credentials secure;

  9. Cooperate with reasonable KYC and verification requests; and
  10. Notify us when your personal information changes.

23. PRIVACY AND PROTECTION OF PERSONAL INFORMATION

Nyaabs Pay may collect, process, store and share personal information necessary to provide its services, comply with legal and regulatory requirements, prevent fraud, conduct KYC and operate the platform.

Personal information may include identification information, contact details, transaction information, device information and other information required for the provision and security of the service.

Where necessary, information may be shared with authorised service providers, financial institutions, payment partners, telecommunications operators, billers, regulators, law-enforcement authorities or other parties where permitted or required by law.

Nyaabs Pay will process personal information in accordance with applicable Ghanaian data-protection laws and its Privacy Policy.

The Bank of Ghana provides a consumer complaints process for customers who remain dissatisfied after seeking redress from their financial service provider.

25. SECURITY

Nyaabs Pay uses reasonable technical and organisational measures designed to protect customer accounts, personal information and transactions.

However, no digital service can guarantee absolute security.

You must immediately notify Nyaabs Pay if you suspect:

  • Unauthorised access;

  • An unauthorised transaction; or
  • Suspicious activity on your account.

27. LIMITATION OF LIABILITY

Nyaabs Pay will take reasonable steps to provide secure and reliable services.

To the extent permitted by applicable law, Nyaabs Pay will not be responsible for losses caused directly by circumstances outside its reasonable control, including failures of telecommunications networks, banks, Mobile Money operators, billers, payment processors, internet providers or other third parties.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under Ghanaian law.

To the extent permitted by law, you agree to compensate Nyaabs Pay for losses, claims, liabilities or expenses arising from your unlawful use of the service, fraud, deliberate misuse of the platform, or material breach of these Terms.
